This Privacy Policy explains what personal information we collect through gearcheck.com and our related websites, applications, and services (the "Services"), how we use and share it, and the choices you have. By using the Services, you agree to this Policy.

1. Information we collect

Information you give us. We may collect this through cookies and similar technologies (see section 6).

Information from others. We may receive information from service providers, such as fraud-prevention and authentication providers, and from sign-in services you choose to connect.

2. How we use information

  • To provide, operate, maintain, and improve the Services;
  • To create and secure your account, including sending one-time verification codes by text message or email;
  • To detect, investigate, and prevent fraud, abuse, and security incidents;
  • To respond to your questions and provide support;
  • To send service and account notices, such as security alerts and policy updates;
  • To comply with law and enforce our Terms and Conditions; and
  • To analyze usage and develop new features.

3. Mobile numbers and text messaging

We collect your mobile number only if you choose to enable SMS-based two-factor authentication or verify your number. We use it to send you one-time security codes and related account security messages, and for no other messaging purpose. We do not send marketing text messages from this program.

We do not sell, rent, or share your mobile phone number or SMS opt-in data and consent with third parties or affiliates for their marketing or promotional purposes. This applies to all mobile information we collect. We may share your number with service providers, such as our text-message delivery provider, solely so they can deliver messages for us, and they may use it only to provide that service to us.

You can stop receiving text messages at any time by replying STOP, and you can ask for help by replying HELP. Message and data rates may apply. Message frequency varies based on your account activity. You can also remove your number from your account settings or by contacting us at privacy@gearcheck.com.

4. How we share information

We do not sell your personal information. We share it only in these cases:

  • Service providers that help us operate the Services, such as hosting, communications and SMS delivery, authentication, analytics, payment processing, and customer support. They are required to protect the data and use it only for our purposes.
  • Legal and safety. When we believe disclosure is required by law or legal process, or necessary to protect the rights, property, or safety of Gearcheck, our users, or others.
  • Business transfers. In connection with a merger, acquisition, financing, or sale of assets. We will require the recipient to honor this Policy for your information or give you notice of any change.
  • With your consent or at your direction.
  • Aggregated or de-identified information that cannot reasonably identify you.

5. Retention

We keep personal information for as long as your account is active or as needed to provide the Services, and then for a reasonable period to meet legal, tax, accounting, security, and dispute-resolution needs. When we no longer need it, we delete or de-identify it.

6. Cookies and similar technologies

We use cookies and similar tools to keep you signed in, remember your preferences, protect against fraud, and understand how the Services are used. You can control cookies through your browser settings, but disabling some may affect how the Services work.

7. Security

We use reasonable administrative, technical, and physical safeguards to protect personal information, including encryption in transit and optional two-factor authentication. No system is completely secure, so we cannot guarantee absolute security. Please use a strong, unique password and enable two-factor authentication.

8. Your choices and rights

You can review and update your account information in your settings, and you can ask us to access, correct, or delete your personal information by emailing privacy@gearcheck.com. We will verify your identity before acting on a request.

Depending on where you live, such as Tennessee, California, or another state with a privacy law, you may have additional rights. These can include the right to know what we collect, to delete or correct it, to obtain a copy, and to opt out of the sale or sharing of personal information or of targeted advertising. We do not sell personal information or share it for cross-context behavioral advertising. You will not be treated unfavorably for exercising your rights. If we decline a request, you may appeal by replying to our response, and you may also contact your state attorney general.

You can opt out of promotional emails using the unsubscribe link in them. We will still send necessary account and security messages.
